Does Wisconsin's lemon law cover used cars?
Reviewed by Cory Gunderson, Internet Sales & Finance Manager · Last checked October 27, 2026
Short answer
No. WisDOT says Wisconsin's Lemon Law covers new vehicles, and used vehicles aren't considered lemons. On a used vehicle, your protection comes from any remaining manufacturer warranty, any dealer warranty, and the disclosures on the Wisconsin Buyers Guide.
What it means in the Barron area
The Lemon Law applies to a new car, truck, motorcycle or motor home with a serious defect in its first year under warranty that the dealer fails to fix in four tries, or that's out of service 30 days or more. Vehicles bought outside Wisconsin, or bought online and delivered outside Wisconsin, aren't covered.
For a used vehicle, read the Buyers Guide to see whether it has remaining manufacturer warranty, a dealer warranty, or is sold As-Is. If a dealer says a manufacturer warranty remains and the manufacturer won't honor it, WisDOT's salesperson manual says the dealer must honor it. If you have a problem with a used vehicle from a Wisconsin dealer, WisDOT suggests filing a dealer complaint.
Worked example Estimate

|---|---|
| Used truck sold with a dealer limited warranty | Covered by the dealer's written terms |
| Used truck sold As-Is | No warranty repairs, but problems known at sale had to be disclosed |
| Lemon Law | Doesn't apply to any of these used examples |

Questions
What if I bought a used car that turns out to have problems?
Check the Buyers Guide and any written warranty first. WisDOT suggests filing a dealer complaint for problems with a used vehicle from a Wisconsin dealer.
Does a remaining factory warranty transfer to me?
Often. WisDOT suggests checking the warranty book or asking the seller what's needed to transfer it.
Who do I call about a Lemon Law question?
WisDOT's Dealer Section consumer hotline is (608) 266-1425.
Are certified pre-owned vehicles covered by the Lemon Law?
No, they're used vehicles. Certified programs come with their own written warranty coverage.
